에볼루션 바카라 무료 13^{에볼루션 바카라 무료} Civil Division of Seoul Southern District Court dismissed all 에볼루션 바카라 무료 claims filed by 에볼루션 바카라 무료 plaintiffs, determining “We find that 에볼루션 바카라 무료 defendant D has violated its duty to use due care under 에볼루션 바카라 무료 Industrial Safety and Health Act, but it is difficult for us to conclude that 에볼루션 바카라 무료 cause of death is a suffocation by 에볼루션 바카라 무료 equipment, and 에볼루션 바카라 무료 possibility of sudden death due to arrhythmia cannot be ruled out. Therefore, it is difficult for us to find that there is a causal relationship between 에볼루션 바카라 무료 defendant D's violation of its duty to use due care and 에볼루션 바카라 무료 death of 에볼루션 바카라 무료 worker, as we cannot find that 에볼루션 바카라 무료 death could have been avoided even if 에볼루션 바카라 무료 defendant D had assigned a person supervising 에볼루션 바카라 무료 work. Since 에볼루션 바카라 무료 rest of 에볼루션 바카라 무료 claims made by 에볼루션 바카라 무료 plaintiffs are also made on 에볼루션 바카라 무료 premise that 에볼루션 바카라 무료 worker was killed in a suffocation, and they have no merits.”

에볼루션 바카라 무료 plaintiffs alleged that 에볼루션 바카라 무료 defendants A and B were liable for damages on 에볼루션 바카라 무료 ground that 에볼루션 바카라 무료 defendant A as owner had failed to take 에볼루션 바카라 무료 industrial accident prevention measures under 에볼루션 바카라 무료 Industrial Safety and Health Act, and 에볼루션 바카라 무료 defendant B took responsibility for 에볼루션 바카라 무료 equipment as a person occupying 에볼루션 바카라 무료 equipment.

With regard to 에볼루션 바카라 무료 claims made against 에볼루션 바카라 무료 defendant A, we argued that 에볼루션 바카라 무료 defendant A was not subject to liability for damages, citing 에볼루션 바카라 무료 legal theory about 에볼루션 바카라 무료 meaning of a “business owner which delegated part of its project that would be conducted in 에볼루션 바카라 무료 same place” and 에볼루션 바카라 무료 industrial accident investigation result published by 에볼루션 바카라 무료 Ministry of Employment and Labor.

With regard to 에볼루션 바카라 무료 claims made against 에볼루션 바카라 무료 defendant B, we argued that 에볼루션 바카라 무료 defendant B could not be regarded as occupier at 에볼루션 바카라 무료 time when 에볼루션 바카라 무료 death incident occurred, on 에볼루션 바카라 무료 basis of legal theory regarding 에볼루션 바카라 무료 issues as to whether 에볼루션 바카라 무료 occupier of a certain equipment would be determined on 에볼루션 바카라 무료 basis of 에볼루션 바카라 무료 then location of 에볼루션 바카라 무료 equipment before 에볼루션 바카라 무료 completion of installation thereof, when 에볼루션 바카라 무료 possession of 에볼루션 바카라 무료 equipment was transferred, and whether a legal relationship existed between 에볼루션 바카라 무료 direct and 에볼루션 바카라 무료 indirect occupiers.

In this case, like 에볼루션 바카라 무료 related criminal case, in which 에볼루션 바카라 무료 defendants were accused of violating 에볼루션 바카라 무료 Occupational Safety and Health Act, 에볼루션 바카라 무료 court dismissed all 에볼루션 바카라 무료 claims made by 에볼루션 바카라 무료 plaintiffs against 에볼루션 바카라 무료 defendants D and its representatives, determining that suffocation could not be seen as 에볼루션 바카라 무료 cause of death.

It is expected that our argument about 에볼루션 바카라 무료 status of a project owner who is responsible for using due care under 에볼루션 바카라 무료 Industrial Safety and Health Act and an occupier who is responsible for equipment in relation to industrial accidents occurring to a worker who is employed by a subcontractor and works in 에볼루션 바카라 무료 premises of 에볼루션 바카라 무료 project owner will be meaningfully utilized in similar industrial accident cases.
