□ The Korean Fair Trade Commission’s order to pay a fine
ㅇ In June 2016, the Korean Fair Trade Commission (the “KFTC”) issued an order against some constructors involved with bid-rigging in relation to the construction of LNG storage tanks to pay a fine of KRW350 billion, which was the largest amount of fine ordered by the KFTC in relation to bid-rigging cases (the “Order”).
ㅇ The KFTC aggravated the fine imposed on SK Engineering and Construction (“SK E&C”) by 20% for the reason that it had violated the Fair Trade Act five times for the past three years. Among the violations was a collusion case in relation to the construction of Gyeongin Canal.
ㅇ In July 2016 right after the KFTC had issued the Order, Seoul High Court ruled that SK E&C had not participated in collusion in relation to the construction of Gyeongin Canal.
