In April 2025, the creditor was subjected to a six-month suspension of qualifications by the Gyeonggi Province Sports Council on the grounds that he had engaged in verbal abuse toward employees. In addition, pursuant to a provision stipulating that suspension of qualifications results in automatic removal from office, the Yongin City Sports Council initiated procedures for a by-election to fill the presidency.

Accordingly, the creditor filed an application for a provisional injunction seeking suspension of the effect of the above suspension of qualifications and a halt to the by-election procedure.

3. Grounds for the Decisions
The court granted the creditor's application after comprehensively considering the following factors:
(i) the creditor's verbal abuse was committed in a somewhat impulsive manner and could be evaluated as relatively minor in nature;
(ii) the regulations of the Gyeonggi Province Sports Council's Sports Fairness Committee mandate, in cases of verbal abuse, disciplinary action exclusively in the form of suspension of qualifications for a period ranging from three months to one year, regardless of the severity or impulsiveness of the conduct, which results in a marked lack of balance in the determination of disciplinary measures and violates the constitutional principle of proportionality; and
(iii) pursuant to the provision that a suspension of qualifications automatically results in removal from the office of president, the creditor would suffer a grave disadvantage tantamount to expulsion or dismissal, which likewise contravenes the principles of proportionality and equality.

We actively demonstrated the necessity of suspending the effect of the disciplinary action and halting the by-election procedure by emphasizing that the disciplinary regulations of the Gyeonggi Province Sports Council's Sports Fairness Committee are unconstitutional provisions that violate the constitutional principles of proportionality and equality, and that the provision mandating automatic removal from office upon suspension of qualifications likewise violates those principles.

5. Significance of the Decisions
The court held that the regulations of the Sports Fairness Committee, which impose a single form of severe disciplinary action (namely, suspension of qualifications) even for impulsive and minor acts of verbal abuse, and which further link such suspension to automatic removal from office, are invalid as they violate the constitutional principles of proportionality and equality. Accordingly, this decision is expected to serve as a meaningful precedent for resolving disputes in cases of similarly unjust outcomes arising under comparable regulations adopted by sports fairness committees of metropolitan and provincial governments nationwide.
