Background of the CaseThe client is a Tier 1 construction company preparing to participate 무료 바카라 게임 a public housing construction bid (LH demand) administered by the Public Procurement Service 무료 바카라 게임 the fourth quarter of 2025. 무료 바카라 게임 2023 and 2024, fatal accidents occurred at the client's construction sites involving workers employed by subcontractors. KOSHA included each of those deaths 무료 바카라 게임 the number of "accident fatalities" occurring at the client's construction sites and, on that basis, notified the client of its 2024 accident fatality rate per 10,000 workers, which was equivalent to the industry average for general construction companies.

ProceedingsAfter being retained 무료 바카라 게임 this matter, we filed a main action seeking confirmation of invalidity with respect to the notification of the 2023 accident fatality rate per 10,000 workers, and seeking revocation with respect to the notification of the 2024 accident fatality rate per 10,000 workers. Grounds for the DecisionThe Seoul Administrative Court held that there was an urgent necessity to prevent irreparable harm to the client that would result from KOSHA's notifications of the 2023 and 2024 accident fatality rates per 10,000 workers. The court further found that there was no evidence indicating that suspension of execution of each of the above dispositions would pose a significant risk to the public interest. On this basis, the court granted all of the motions for suspension of execution.
4. Our Role and ArgumentsOur Administrative/Tax Practice Group (lead attorneys: Park Sung-ho and Sohn Su-young) conducted a meticulous analysis of the factual background and argued that the harm suffered by the client as a result of the challenged dispositions was severe and constituted irreparable harm. In addition, through in-depth research into the relevant provisions of the Occupational Safety and Health Act and related regulations, as well as the constitutional principle of self-responsibility, the team developed and rigorously advanced the legal argument that the deaths resulting from the relevant accidents should not be included in the calculation of the client's number of accident fatalities, and accordingly should not be reflected in the calculation of the accident fatality rate per 10,000 workers.
In particular, drawing on our prior experience as the first domestic law firm to obtain a suspension of execution decision regarding an accident fatality rate notification issued to a specialized construction company in the previous year, and again as the first domestic law firm to obtain a suspension of execution decision regarding such a notification issued to a general construction company earlier this year, the Administrative/Tax Practice Group actively participated in the hearings on the motions for suspension of execution and persistently persuaded the court.
